The Tenant proved the allegations contained in the application on a balance of probabilities. The Landlords are ordered to pay the Tenant $2,536.34, which includes a rent refund, increased rent for the new tenancy, general damages, and the application fee. The Landlord George Crawford is also ordered to pay an administrative fine of $300.00 to the LTB.
Tenant applied for an order determining that the Landlords entered the rental unit illegally, altered the locking system without providing replacement keys, substantially interfered with the Tenant's reasonable enjoyment, and harassed the Tenant. The Tenant also alleged that the Landlords collected or retained money illegally.
Landlord Belinda St Ville requested to be removed as a party due to an ongoing civil action involving the other Landlord, where they were instructed to have nothing to do with the property.
Landlords removed the Tenant's possessions from the garage and the Tenant's room on October 22 and 23, 2023 without notice. Landlords changed the locks and codes, preventing the Tenant from returning to the unit.
Tenants vacated the rental unit on October 23, 2023 after the Landlords changed the locks and removed their possessions.
