1. Acceptance of Terms

Welcome to RentZen ("Company", "we", "our", "us"). These Terms of Service ("Terms", "Terms of Service") govern your use of our website located at www.rentzen.ca (together or individually "Service") operated by RentZen. By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

2. Use of Our Services

Our services are designed to provide information about rental history and landlord-tenant disputes. You may use our services only for lawful purposes and in accordance with these Terms. You agree not to use our services:

  • In any way that violates any applicable federal, provincial, local, or international law or regulation.
  • To impersonate or attempt to impersonate the Company, a Company employee, another user, or any other person or entity.
  • To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Service, or which, as determined by us, may harm the Company or users of the Service or expose them to liability.

We reserve the right to terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

3. Not Legal Advice

The content provided on RentZen is for informational purposes only and does not constitute legal advice. The information provided about rental history, landlord-tenant disputes, and related matters should not be construed as legal advice or relied upon as such. This information is not a substitute for professional legal counsel.

We strongly recommend that you consult with a qualified legal professional for advice concerning specific legal issues or problems. Your situation may involve facts and circumstances that are unique to you, which can significantly affect your legal rights and responsibilities.

By using our Service, you acknowledge and agree that RentZen is not a law firm and does not provide legal services. Your use of the Service does not create an attorney-client relationship between you and RentZen or any of its employees or agents.

4. Intellectual Property

The Service and its original content (excluding Content provided by users), features and functionality are and will remain the exclusive property of RentZen and its licensors. The Service is protected by copyright, trademark, and other laws of both Canada and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of RentZen.

5. User Content

Our Service allows you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material ("Content"). You are responsible for the Content that you post to the Service, including its legality, reliability, and appropriateness.

By posting Content to the Service, you grant us the right and license to use, modify, publicly perform, publicly display, reproduce, and distribute such Content on and through the Service. You retain any and all of your rights to any Content you submit, post or display on or through the Service and you are responsible for protecting those rights.

You represent and warrant that: (i) the Content is yours (you own it) or you have the right to use it and grant us the rights and license as provided in these Terms, and (ii) the posting of your Content on or through the Service does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person.

6. User-Uploaded Court Records and Public Information

Our Service allows users to upload and share court records and other public information related to rental disputes and landlord-tenant matters. By uploading such Content, you agree to the following:

  • Accuracy and Completeness: You are solely responsible for ensuring the accuracy, completeness, and currency of any Content you upload. RentZen does not verify or validate the information contained in user-uploaded Content.
  • Legal Compliance: You warrant that you have the legal right to upload and share the Content, and that doing so does not violate any laws, regulations, or court orders.
  • Personal Information: While the Content you upload may contain names and other personal information of individuals involved in court proceedings, you agree to only upload information that is part of the public record and legally permissible to share.
  • No Expectation of Privacy: You understand and agree that any Content you upload to the Service will be publicly accessible. Do not upload any information that you or others have a reasonable expectation of privacy in.
  • Indemnification: You agree to indemnify and hold RentZen harmless from any claims, damages, or legal actions arising from the Content you upload, including but not limited to claims of privacy violations, defamation, or copyright infringement.
  • Removal Requests: While RentZen is not obligated to remove publicly available court records, we reserve the right to remove any Content at our discretion, especially if we receive valid legal requests or if the Content is found to violate these Terms.
  • Updates and Corrections: You are responsible for updating or correcting any information you have uploaded if it becomes outdated or is found to be inaccurate. RentZen does not assume responsibility for maintaining or updating user-uploaded Content.
  • No Endorsement: RentZen does not endorse or verify the accuracy of user-uploaded Content. Users of the Service are advised to independently verify any information they find on the platform.

7. Accuracy of Information

While we strive to provide accurate and up-to-date information about rental history and landlord-tenant disputes, we make no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability or availability with respect to the Service or the information, products, services, or related graphics contained on the Service for any purpose. This includes, but is not limited to, any user-uploaded Content. Any reliance you place on such information is therefore strictly at your own risk.

Furthermore, the information provided on RentZen, including user-uploaded Content, should not be used as a substitute for legal advice. We strongly encourage users to seek professional legal counsel for specific legal matters.

8. Limitation of Liability

In no event shall RentZen, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • your access to or use of or inability to access or use the Service;
  • any conduct or content of any third party on the Service, including without limitation, any defamatory, offensive or illegal conduct of other users or third parties;
  • any content obtained from the Service;
  • unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose;
  • any legal consequences resulting from the use of or reliance on the information provided through the Service, including user-uploaded Content; and
  • any claims or actions arising from user-uploaded Content, including claims of privacy violations, defamation, or copyright infringement.

9. Limitation of Liability

In no event shall RentZen, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose; and (v) any legal consequences resulting from the use of or reliance on the information provided through the Service.

10. Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

RentZen, its subsidiaries, affiliates, and its licensors do not warrant that a) the Service will function uninterrupted, secure or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components; or d) the results of using the Service will meet your requirements.

RentZen explicitly disclaims any liability resulting from the use or application of the information provided on the Service. The information is not intended to create, and receipt or viewing of it does not constitute, an attorney-client relationship.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of Ontario, Canada, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

12. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.

13. Indemnification

You agree to defend, indemnify and hold harmless RentZen and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of:

  • your use and access of the Service, by you or any person using your account and password;
  • a breach of these Terms;
  • Content posted on the Service, including but not limited to user-uploaded court records and public information;
  • any misrepresentation made by you in connection with your use of the Service;
  • your violation of any rights of a third party, including but not limited to intellectual property rights or privacy rights; or
  • any claim that your Content caused damage to a third party.

This defense and indemnification obligation will survive these Terms and your use of the Service.

14. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

15. Entire Agreement

The Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.
