The Tenant failed to properly disclose issues under section 82 of the Act, so those issues were not considered. The Landlord served a valid N4 Notice, the Tenant did not void it, and the Tenant was still in possession at the time of the hearing. The Tenant owes $11,391 to void the order or $10,717.39 if the tenancy is terminated. If the Tenant does not pay by March 23, 2025, the Landlord may file the order with the Sheriff for enforcement.
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid N4 Notice, which the Tenant did not void by paying the arrears. The Tenant was still in possession of the rental unit at the time of the hearing.
Tenant stated he lost his job at the end of 2022 and spent the next year going back and forth with Employment Insurance for his back pay, leading to the rent arrears.
