The tenancy is terminated unless the Tenant voids the order by paying $8,236 by February 28, 2025 or $9,216 by March 31, 2025. If the Tenant does not void the order, the Tenant must move out by March 31, 2025 and pay the Landlord $7,674.86 plus daily compensation.
Tenant requested relief from eviction, stating he intends to repay the Landlord but is awaiting confirmation from social assistance and job interviews. In the absence of evidence demonstrating financial hardship to the Landlord, the eviction is postponed until March 31, 2025 to give the Tenant opportunity to find alternative accommodations.
Landlord applied for an order to terminate the tenancy and evict Tenant due to non-payment of rent. The Landlord served a valid N4 Notice, and the Tenant did not void the notice by paying the arrears.
Landlord's Representative opposed the Tenant's requests, arguing that the tenancy is not viable, and any delay would be prejudicial to the Landlord due to the substantial arrears.
Tenant testified he was unable to pay rent due to losing his job in April 2024 and has been unable to find consistent work since then. He requested relief from eviction, stating he intends to repay the Landlord but is awaiting confirmation from social assistance and job interviews.
Tenant did not provide a reasonable explanation for failing to disclose his evidence to the Landlord and the Board at least seven days prior to the hearing, as required by Rule 19.4 of the Board's Rules of Procedure.
