Landlord applied for an order to terminate the tenancy and evict Tenants due to non-payment of rent. The Tenants' legal representative challenged the validity of the N4 Notice served by the Landlord.
The $12,000 rent is the lawful rent as agreed upon by the parties for the new tenancy formed as part of the amendment to the APS, and the Board should consider section 202 of the Residential Tenancies Act, 2006.
The rent increase from $7,433 to $12,000 per month is illegal and renders the N4 Notice invalid.
