Tenant requested extension to March 1, 2025 due to domestic dispute with other tenant, and landlord agreed
Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. As of the hearing date, the tenants were still in possession of the rental unit.
The Landlord seeks a termination of the tenancy as the rent arrears are substantial and the Tenant has not been responsive to efforts to establish a repayment plan for the rent arrears.
Tenant Ms. MacCandless testified that she was in a domestic dispute with the other Tenant, Mr. Lopes, and he is prohibited from being at the rental unit, and she is prohibited from having contact with him. Mr. Lopes was previously the sole Tenant who was employed, and Ms. MacCandless is not able to pay off the rent arrears and continue the tenancy.
