The Landlord has proven the grounds for termination of the tenancy and the claim for compensation. The tenancy is terminated effective October 31, 2024. The Tenants must pay the Landlord $9,729.79, which includes compensation for use of the unit and the application fee, minus the rent deposit and interest. If the Tenants do not vacate by October 31, 2024, the Landlord may file the order with the Court Enforcement Office for enforcement.

Landlord applied for an order to terminate the tenancy and evict Tenants because the Landlord in good faith requires possession of the rental unit for the purpose of residential occupation for at least one year.
Landlord testified that she, along with her husband, and two children, have had to move into their father's home temporarily and that they are cramped for space. She testified that her father's house is too small to accommodate the entire family and that they wish to have their individual space.
Tenants submitted that they are not opposed to vacating the unit but simply require more time to do so as finding a suitable unit to move to, has been challenging for them.
