The tenancy is terminated unless the Tenant pays $19,086 to void the order by September 27, 2024. If the Tenant does not void the order, they must pay $13,312.15 to the Landlord and vacate the unit by September 27, 2024. The Tenant will owe daily compensation of $88.77 for any additional days of occupancy after August 27, 2024.
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid N4 Notice, which the Tenant did not void by paying the arrears. The Tenant was still in possession of the rental unit at the time of the hearing.
Landlord's Legal Representative, on behalf of the Landlord, offered to negotiate a payment plan with the Tenant on April 8, 2024.
Tenant requested a conditional order that would require the Tenant to pay the rent in full while paying an additional $1,000.00 towards the arrears each month.
Tenant is a single parent of 2 small children whose partner and other roommate moved out, leaving the Tenant alone to carry the cost of the rent. The Tenant has difficulty finding work due to the requirement to take medications and has to date been unable to apply for housing assistance because the process has been overwhelming.
