The Tenant proved the Landlords served the N12 notice in bad faith, as they rented out the basement of the unit to their niece after the Tenant vacated. The Landlords must pay the Tenant $27,081.12 in general compensation plus the $48 filing fee.
Tenant applied for an order determining that Landlords gave a notice of termination in bad faith. The Landlords served the Tenant with an N12 notice stating that their son required the rental unit, and the Tenant vacated the unit as a result. However, the Landlords rented out the basement of the unit to their niece, which the Tenant argued was evidence of bad faith.
Landlords asked Tenant to pay higher rent, let them renovate basement, or share unit with their son before serving N12 notice.
Tenant agreed to move out because he did not feel he had a choice.
