The Landlord's application is granted. The tenancy is terminated effective June 30, 2024. If the unit is not vacated by that date, the Landlord may file the order with the Sheriff for enforcement. The Tenant must also pay the Landlord $186 for the application filing fee. If the Tenant does not pay the full amount owing by June 30, 2024, they will owe interest at 7% annually starting July 1, 2024.
Tenant had funds to pay rent but prioritized other expenses, prejudicial to Landlord. Tenant has been to LTB multiple times and should understand importance of paying rent on time.
Landlord applied for an order to terminate the tenancy and evict the Tenant due to persistent late payment of rent. The Landlord served a valid N8 notice, and the Tenant continued to pay rent late or not at all, resulting in over $7,000 in rent arrears.
Tenant testified that the reason for delayed rental payments and arrears were due to the Landlord not accepting cash and unexpected repairs to his work vehicles. Tenant also asserted there was a verbal agreement with the Landlord's superintendent to preserve the tenancy if he paid the arrears by the end of the month.
