The Landlord's application is granted. The tenancy continues if the Tenant refrains from leaving objects in common areas and generating disruptive noise for the next 12 months. If the Tenant fails to comply, the Landlord may apply to terminate the tenancy without notice to the Tenant. The Tenant must pay the Landlord $186 for the application filing fee.
Given the Tenant's age and the length of the tenancy, it would not be unfair to provide the Tenant with an opportunity to preserve the tenancy if the Tenant refrains from the behaviours complained of in the notices of termination.
Landlord applied for an order to terminate the tenancy and evict Tenant due to the Tenant, another occupant of the rental unit or someone the Tenant permitted in the residential complex substantially interfering with the reasonable enjoyment or lawful right, privilege or interest of the Landlord or another tenant.
Landlord made numerous attempts to contact the Tenant on the hearing day, but the Tenant was not present or represented at the hearing although properly served with notice
Tenant was heard yelling and screaming from 7:00 p.m. to 2:00 a.m. on March 21, 2022, Tenant was heard yelling and screaming at Joseph from 9:30 p.m. to 11:00 p.m. on April 6, 2022, Tenant told other tenant to 'mind your own business'
Tenant continues to yell and scream, police regularly visit Tenant's unit, Tenant harasses other tenant
