The Landlord's L2 application is dismissed. The Tenant shall pay the Landlord $700.00 on or before December 10, 2024. If the Tenant does not pay the Landlord the full amount owing on or before December 10, 2024, the Tenant will start to owe interest at 6.00% annually on the balance outstanding.
Landlord applied for an order to terminate the tenancy and evict the Tenant because the Landlord has entered into an agreement of purchase and sale of the rental unit and the purchaser in good faith requires possession of the rental unit for the purpose of residential occupation.
The Landlord testified she decided to sell her rental property as she did not want to be a landlord anymore. The Landlord testified that the rental unit was sold on May 20, 2024 and the closing had been delayed three times due to the Tenant not vacating the rental unit.
The Tenant challenged the validity of the Agreement of Purchase and Sale and the purchaser's good faith intention to move into the rental unit.
The Tenant testified, in detail, of his personal circumstances in accordance with section 83 of the Residential Tenancies Act, 2006.
