The Tenant shall pay to the Landlord $15,962.29 which represents the amount of rent owing up to August 31, 2020 less the last month rent deposit and interest owing on the deposit. The Tenant shall also pay to the Landlord $190.00 for the cost of filing the application. If the Tenant does not pay the Landlord the full amount owing on or before June 30, 2021, the Tenant will start to owe interest. This will be simple interest calculated from July 1, 2021 at 2.00% annually on the balance outstanding.
Landlord applied for an order requiring Tenant to pay the rent that the Tenant owes. The application was resolved by order SWL-40249-20 issued on May 22, 2020. The Landlord requested a review of the order because they did not receive the Notice of Hearing.
The Landlord continuously advertised and reposted using Kijiji from January 11, 2020 to August 4, 2020. The Landlord also reposted and advertised individual rooms in another attempt to find prospective tenants.
The Tenant moved out her property on December 20, 2019; she went back to the unit to clean it on December 29, 2019; and on or a few days after January 14, 2020 she to returned to the unit to take pictures of the vacant unit.
The Tenant's oral notice to the Landlord did not comply with section 44 of the Act and she did not obtain the consent of the Landlord to terminate the tenancy early.
