The Landlord must pay the Tenant the last month's rent deposit of $650.00, interest on the deposit of $46.80, and the cost of the application filing fee of $53.00, totalling $749.80. The Landlord illegally retained the last month's rent deposit, as the parties had agreed to terminate the tenancy and the rent for the last month was already paid.
Tenant applied for an order determining that the Landlord collected or retained money illegally. The Tenant sought the refund of the last month's rent deposit and interest on the deposit.
Landlord alleged that the Tenant didn't pay utilities as required, caused damage to the rental unit, and didn't provide sufficient notice to terminate the tenancy.
Tenant provided verbal notice of intent to move out in May 2024, paid June 2024 rent, and followed up with a text notice on June 4, 2024 that he would be vacating the rental unit on June 30, 2024.
