The tenancy is terminated unless the Tenant voids the order by paying the outstanding rent arrears of $5,119 by December 31, 2024, $7,246 by January 31, 2025, or $9,373 by February 28, 2025. Significant impact on Tenant and her disabled daughter, who attend school in the local area and have strong community connections. More time needed to secure new housing.
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid N4 Notice, which the Tenant did not void by paying the arrears. The Tenant was still in possession of the rental unit on the hearing date.
Landlord submitted that the parties have attempted to work out a payment plan to no avail, since the application was filed.
Tenant testified to the impact an eviction would have on her and her disabled daughter, explaining they are a single income family and her daughter attends school in the local area and has significant connection to the community.
Tenant did not provide timely disclosure of materials for Section 82 issues.
