The tenancy is terminated unless the Tenant pays $5,436 by February 23, 2025 to void the order. If the Tenant does not pay, they must vacate by February 23, 2025. If the Tenant does not void the order, they must pay the Landlord $4,664.17 plus daily compensation of $21.37 starting January 30, 2025 until they move out.

Landlord applied for an order to terminate the tenancy and evict Tenant due to non-payment of rent and persistent late payment of rent. The Landlord served a valid N4 notice, and the Tenant did not void the notice by paying the arrears. The Tenant was still in possession of the rental unit at the time of the hearing.
Landlord submitted text messages between the parties showing the Tenant acknowledged the rent was $750 per month.
Tenant argued the amount of monthly rent in the N4 notice was incorrect and should be $600 per month, not $750.
Tenant testified the amount of arrears did not reflect a payment he made in March 2024.
