The Landlord collected a rent deposit but did not give the prospective Tenant vacant possession of the rental unit. Therefore, the Landlord must repay the rent deposit of $800.00 to the Tenant.
The Tenant applied for an order determining that the Landlord collected or retained money illegally. The Tenant responded to a Facebook listing, viewed the unit, and provided a rent deposit of $800, but the Landlord later informed the Tenant that she would need to stay for the entire school year until April 2025, which was unacceptable to the Tenant. The Tenant then asked for the deposit back, but the Landlord did not return it.
