The Tenant proved the allegations contained in the application on a balance of probabilities. The Landlord must carry out the repairs ordered, pay the rent abatements ordered and out of pocket expenses, and cease from illegal entry into the unit.
Tenant applied for an order determining that the Landlord entered the rental unit illegally, withheld or interfered with their vital services, and failed to meet the Landlord's maintenance obligations under the Residential Tenancies Act, 2006.
Landlord denied the illegal entry, testifying that his wife went to the property and the Tenant opened the door for her.
Tenant claims Landlord and/or Landlord's wife entered the rental unit illegally on January 18, 2023, causing her stress. Tenant also claims Landlord failed to repair furnace, floor, toilet, and stove in a timely manner.
