We estimate Application Date using rent arrears.
The tenancy shall continue, subject to the Tenant paying off the arrears of $9,111 in monthly installments of $1,100 from January 22, 2025 to August 22, 2025, and $311 on September 22, 2025. The Tenant shall also pay the rent in full and on time, commencing February 1, 2025 to September 1, 2025. If the Tenant fails to make the payments, the Landlord may apply to the LTB for an order terminating the tenancy and evicting the Tenant.
Tenant had fallen on hard times but prioritized paying off the arrears when money came in
Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenants were still in possession of the rental unit at the time of the hearing.
Landlord stated that this issue had happened once in the past, and there were issues with late payment over the last two years. Landlord is tired of this situation and has to keep the property up and hire legal counsel to deal with the arrears.
Tenant had trouble with his job last year, lost his job, but received a payout from his last employer and used those funds to pay off the Landlord. Tenant is looking for a new job now and has money coming in as of January 2025, $2500 each month, and also receives child tax of $1,000. Tenant offered to pay $700/month to pay off the arrears and also makes about $400/month from babysitting.
