Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenants were still in possession of the rental unit at the time of the hearing.
Landlord testified there is prejudice to him as he is struggling to pay his mortgage.
Tenant Jennifer Mclean testified she fell behind on rent due to being off work for medical reasons and only receiving Ontario Works income of $733/month. Tenant Luke Tenbrinke testified he was laid off and only receives $2,000/month in EI, which is barely enough to cover the rent.
