Tenants requested time to pay arrears and a conditional order to pay rent on time for 12 months
Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent and persistent late payment of rent. The Landlord served valid N4 and N8 notices, but the Tenants did not void the notices by paying the arrears.
Landlord requested a standard order for the arrears and an order for eviction based on the persistently late payments of rent.
Landlord testified that he has put off his wedding due to the arrears that the Tenants owe and that the cost to carry the condo exceeds the monthly rent by more than $1,000.
Tenants requested until December 31, 2023 to clear the outstanding arrears and a conditional order to pay rent on time for the next 12 months.
Tenant S. Lagundzija was incarcerated from January 2023 to October 2023 and fell behind in payments. Tenant N. Hamid receives ODSP and her income from cleaning houses fluctuates monthly.
