Landlord applied for an order to terminate the tenancy and evict the Tenant due to non-payment of rent. The Landlord served the Tenant with a valid N4 Notice, but the Tenant did not void the notice by paying the rent arrears.
Landlord's representative stated that the current Landlord took over the residential complex on July 22, 2023, and the previous Landlord also has a L9 order for rent arrears against the Tenant. The Tenant has a history of rent arrears applications from previous tenancies.
Tenant testified that when he moved in, his father came from China to live with him and he was supposed to help with the rent, but his father got sick and he had to take care of him. His father has now moved out and the Tenant is seeking work actively.
