The tenancy is terminated unless the Tenants pay $6,536 by May 20, 2023 to void the order. If the Tenants do not pay, they must vacate the unit by May 20, 2023 and pay the Landlord $4,108.32 plus $32.88 per day in compensation from April 18, 2023 until move-out, and $695.85 for unpaid utility bills.
Landlord applied for an order to terminate the tenancy and evict Tenants due to non-payment of rent and persistent late payment of rent. The Landlord served valid N4 and N8 notices, but the Tenants did not void the notices by paying the arrears.
Landlord testified that the Tenants' lease requires them to pay water, electricity, and heat charges, and that the water bills have not been paid and have been added to the Landlord's property taxes.
The N8 notice was defective as it did not provide sufficient details on the late rent payments.
