The Landlord applied for an order to terminate the tenancy and evict the Tenant because the Landlord in good faith requires possession of the rental unit for the purpose of residential occupation for at least one year by the Landlord's child. The Landlord also claimed compensation for each day the Tenant remained in the unit after the termination date.
The Landlord's child intends to use the rental unit for more space for his family.
The Tenant alleges that the notice of termination was given to her because she complained to a governmental authority of the Landlord's violation of a law regarding health, safety, housing, or maintenance standards, and/or because the Tenant attempted to secure or enforce her legal rights.
The Tenant found paint chipping, which was determined by testing to be lead paint. The Tenant complained about this both to the Landlord and to the Ontario Public Health Agency.
The request to review the September 19, 2023 order is denied. The order is confirmed and remains unchanged. The interim order issued on October 19, 2023 is cancelled. The stay of order LTB-L069973-22 is lifted on May 31, 2024.
