The tenancy between the Landlord and the Tenant is terminated, and the Tenant must move out of the rental unit on or before November 9, 2021. The Tenant shall also pay the Landlord $186.00 for the cost of filing the previous application. If the Tenant does not pay the cost by November 9, 2021, the Tenant will start to owe interest at 2.00% annually on the outstanding balance.
Landlord applied for an order to terminate the tenancy and evict the Tenant because the Tenant failed to meet a condition specified in the order issued by the Board on August 19, 2021 with respect to application SWL-49745-21. The Tenant engaged in loud noises, yelling, and other disruptive behavior that substantially interfered with the reasonable enjoyment of other tenants.
As the Tenant did not meet the conditions of the previous order, the Landlord is entitled to an order terminating the tenancy and evicting the Tenant.
The Landlord provided evidence of continued incidents of loud noises, yelling, and other disruptive behavior from the Tenant's unit, similar to the issues described in the previous N5 notices.
