The tenancy is terminated and the Tenant must move out by December 31, 2022. The Tenant owes the Landlord $5,763.16 in compensation for use of the unit from April 30 to September 8, 2022, and an additional $43.66 per day from September 9 until the move-out date. If the full amount is not paid by December 31, 2022, the Tenant will owe interest at 3% annually on the outstanding balance starting January 1, 2023.
Landlord applied for an order to terminate the tenancy and evict Tenant because the Landlord in good faith requires possession of the rental unit for the purpose of residential occupation for at least one year.
Landlord testified their plan is to make the rental unit their 'forever home' and that they currently live in a friend's basement and pay rent there. Much of their belongings have been in storage since October 2021.
Tenant testified she has been looking for a new place to live since receiving the first N12 notice from the Landlord.
