The tenancy is terminated effective July 31, 2021. The Tenant must vacate the unit by that date. The Tenant is ordered to pay the Landlord $65.56 per day for use of the unit after August 1, 2021 until the Tenant vacates, as well as $190 for the application filing fee. If the Tenant does not pay the full amount owed by May 2, 2021, interest will accrue at 2% annually on the outstanding balance.
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The Tenant testified that she is a single mother with limited financial means and has not been able to pay rent in full on the first of each month for the last 12 months.
Tenant argued she had an oral agreement with the property manager to pay rent around the 20th of the month, not the 1st.
Tenant is a single mother with 5 children, has limited financial means and must resort to food banks. She stopped receiving child tax benefits due to COVID-19 and currently receives $1000 from Ontario Works and $450 bi-weekly from COVID-19 emergency benefits.
