Tenants must pay $7,824.09 for rent arrears and compensation, plus $57.53 per day from January 15, 2022, until they move out. The Landlord may file for eviction enforcement if the unit is not vacated by January 31, 2022.
Landlord applied for an order to terminate the tenancy and evict Tenants due to non-payment of rent. Tenants owed substantial arrears and had not paid rent for five months. Tenant proposed an unreasonable payment plan of $250 per month, which would take 35 months to clear the balance.
Landlord argued that a 35-month payment plan is prejudicial and that the Tenant made no attempts to negotiate until the day of the hearing.
Landlord sent two letters offering to discuss reasonable payment plans, dated September 14, 2021, and October 5, 2021.
Tenant claimed inability to pay rent due to COVID-19 and personal relationship issues leading to depression. However, no medical evidence was provided to support mental health claims.
