We estimate Application Date using rent arrears.
The Tenant shall pay the Landlord $5,636.00 for arrears of rent up to August 31, 2023 and costs, in accordance with a payment schedule. The Tenant shall also pay the monthly rent as it becomes due. If the Tenant fails to make any one of the payments, the outstanding balance shall become immediately due and owing, and the Landlord may apply to the LTB for an order terminating the tenancy and evicting the Tenant.
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the Tenant did not void by paying the arrears. The Tenant was still in possession of the rental unit on the hearing date.
Landlord's Agent submitted that discussions with the Tenant in relation to the rent arrears began in March 2023 and the Tenant did follow through with some payments, but over time the Tenant began to miss payments and stopped responding to the Landlord's attempts to contact her.
Tenant requested the Board issue a conditional order that would require the payment of the monthly rent on time and in full as well as a meaningful payment towards the rent arrears.
Tenant testified that she had been on sick leave from her employment from late December 2022 until July 13, 2023, and suffers from mental health issues including PTSD and bipolar disorder. She stated she lives alone and would have nowhere to go if evicted.
