Tenancy End Date
Aug 2023
The tenancy will be terminated on August 31, 2023 unless the Tenant pays $8,850 by July 31, 2023 or $10,802.90 by August 31, 2023 to void the order. If the Tenant does not void the order, they must pay $5,288.53 to the Landlord, which includes rent arrears up to the hearing date and the cost of filing the application, minus the rent deposit and interest on the deposit.
to allow the Tenant time to make payments to the Landlord and/or seek alternative support or accommodation
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the Tenant did not void by paying the arrears. The Tenant was still in possession of the rental unit on the hearing date.
Landlord seeks a standard order.
Landlord asserts that the Tenant's income is unpredictable and the arrears of rent continue to mount, placing strain on the Landlord. Landlord says the Tenant provided scant information during the financial analysis and has not made any effort to reach out to social support or seek alternative accommodations.
Tenant started a new job as a long haul truck driver around June 24, 2023 and expects to earn around $4,000 per month. Tenant believes he can pay the arrears by September 30, 2023.
