The Landlord's application is dismissed. The Landlord has not proven on a balance of probabilities the grounds for termination of the tenancy. The Landlord's conduct and motives call into question the good faith of the application, and it would be unfair to evict the long-term senior tenants.
Tenants are long-term senior residents, eviction would be unfair
Landlord applied for an order to terminate the tenancy and evict Tenants because the Landlord in good faith requires possession of the rental unit for the purpose of residential occupation for at least one year by the Landlord's spouse. The Landlord also claimed compensation for each day the Tenants remained in the unit after the termination date.
Landlord attempted to substantially increase rent, told Tenants the property would be sold if they did not pay higher rent
