The Landlords' application to terminate the tenancy and evict the Tenants and Unauthorized Occupants is granted. The Tenants have persistently failed to pay rent and have transferred the tenancy to the Unauthorized Occupants without the Landlords' consent. The Unauthorized Occupants are given until March 31, 2025 to vacate the unit, provided they pay rent and utilities during that time.
To allow Unauthorized Occupants time to find alternate accommodations
Landlords applied for an order to terminate the tenancy and evict Tenants and Unauthorized Occupants due to non-payment of rent and unauthorized occupancy. The Tenants had vacated the rental unit in 2019 and allowed various individuals, including the Unauthorized Occupants, to occupy the unit without the Landlords' consent.
Landlords provided less than ideal documentary evidence to support N5 application
Tenants were 'mitigating' their damages by having paying 'roommates' in the unit.
