The Landlord must pay the Tenants $3,773.54 on or before November 23, 2024, which includes $920.54 for excess rent collected, $2,800.00 for the last month's rent deposit, and $53.00 for the cost of filing the application. The Tenants are entitled to the return of any rent they paid for the period beginning December 21, 2023, onward.
Tenants applied for an order determining that the Landlord collected or retained money illegally. The Tenants alleged that the Landlord owes them $5,600.00 for the return of one month's prepaid rent, and the return of the last month's deposit.
Landlord testified that he received a telephone call from the Tenant on October 6, 2023 providing 60 days notice to terminate the tenancy, and that the rental unit was re-rented on December 21, 2023.
Tenant testified that he lost his job and did not want bad credit, so he provided notice to the Landlord that he would be vacating the rental unit.
