The Tenant proved the allegations of illegal entry and harassment by the Landlord on a balance of probabilities. The Landlord is ordered to pay the Tenant $13,648, which includes a rent abatement, rent differential, and application filing fee.
Tenant applied for an order determining that the Landlord illegally entered the rental unit and harassed, obstructed, coerced, threatened or interfered with the Tenant. The Landlord did not attend the hearing.
Tenant testified that on July 7, 2022, the Landlord entered her rental unit without proper notice or consent under the pretense of conducting maintenance. After initially leaving, the Landlord returned alone, forcibly re-entered the unit, and physically assaulted the Tenant.
