The Landlord breached his maintenance obligations by failing to respond in a timely and effective manner to the Tenants' complaints about potential mould. The Tenants are entitled to a rent abatement of $900 for this period. The Tenants are also entitled to a rent abatement of $129.58 for the Landlord's failure to address the mouse infestation in a timely manner, and $53 for the cost of filing the application.
Tenants applied for an order determining that the Landlord failed to meet the Landlord's maintenance obligations under the Residential Tenancies Act, 2006 or failed to comply with health, safety, housing or maintenance standards. The issues included a mouse infestation, sewage backflow, and potential mould.
Tenants moved out before Landlord could address issues.
Landlord said he would address mouse issue but did not, and dismissed Tenants' concerns about mould.
Landlord failed to meet maintenance obligations under the Residential Tenancies Act.
Tenants found mouse droppings, reported issue to Landlord, and set their own traps when Landlord did not respond. Tenants also reported sewage backflow and musty odor, and eventually vacated the unit due to concerns about mould.
