The Landlord failed to maintain the HVAC system in the rental unit, leading to the Tenant developing health issues. The Landlord must pay the Tenant $500, which includes $452 for air quality testing and the $48 filing fee.
Tenant applied for an order determining that the Landlord failed to meet its maintenance obligations under the Residential Tenancies Act, 2006, specifically regarding the HVAC system in the rental unit. The Tenant claimed she developed health issues due to the Landlord's failure to maintain the HVAC system.
Landlord attempted to enter unit on multiple occasions, and had HVAC system cleaned in January 2024. Landlord's agent testified that no mold was found.
Tenant notified Landlord of HVAC issues on October 14, 2023. Tenant continued to experience symptoms after HVAC was cleaned, and provided photographic evidence of ongoing issues.
