The Landlord must pay the Tenant $5,048 in general damages and application filing costs, and an administrative fine of $5,000 to the LTB. The Landlord shall not collect rent for the period of August 2, 2022 to September 19, 2022. The tenancy is terminated as of October 31, 2022.
Tenant applied for an order determining that the Landlord entered the rental unit illegally, altered the locking system without providing replacement keys, substantially interfered with the reasonable enjoyment of the rental unit, and harassed, obstructed, coerced, threatened or interfered with the Tenant.
Tenant was locked out of the rental unit on August 2, 2022 while attending an appointment, and was told by the Landlord's staff that she had no right to occupy the unit and would only be allowed to collect her belongings. Tenant spent a night in the park, stayed in shelters, and temporarily stayed with a colleague.
