The Landlord has proven the grounds for termination of the tenancy. The tenancy between the Landlord and the Tenant is terminated, and the Tenant must move out of the rental unit on or before November 17, 2024. The Landlord is not required to compensate the Tenant with respect to the N13 Notice, and it would be unfair to grant the Tenant relief from eviction.
Landlord applied for an order to terminate the tenancy and evict the Tenant because the Landlord requires vacant possession of the rental unit in order to do major repairs or renovations to the unit as ordered by the City of Welland.
