The Act does not apply to this tenancy as the Tenant was required to share the kitchen facility with the Landlords, who lived in the same building. The Landlords and their family consistently used the basement kitchen since 2007, and the Tenant acknowledged infrequent use of the kitchen. Therefore, the Board lacks jurisdiction to hear the Tenant's application, which is dismissed.
Tenant applied for an order determining that the Landlords entered the rental unit illegally, altered the locking system without providing replacement keys, substantially interfered with the reasonable enjoyment of the rental unit, and harassed, obstructed, coerced, threatened or interfered with the Tenant.
