Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenants were still in possession of the rental unit on the hearing date.
Landlord attempted to communicate with the tenants regarding a repayment plan in December 2023 and every month up until the hearing date, but did not receive a response from the tenants.
Tenants were behind on rent due to the tenant's car accident and inability to work. The tenant is now able to work and will start a new job in May 2024. The tenant's spouse has a monthly income of $3,200 and is willing to contribute earnings to the arrears. The tenants have 4 children and want to maintain the tenancy as there is a child welfare issue pending.
The tenancy is terminated unless the Tenants pay $53,250 to void the order and continue the tenancy, or $27,723.39 if the tenancy is terminated. If the Tenants do not pay the required amount by July 15, 2024, they must vacate the unit and the Landlord can file the order with the Sheriff to enforce the eviction.
