The tenancy is terminated unless the Tenants pay $53,501 to void the order by October 20, 2024. If the Tenants do not void the order, they must vacate the unit by October 20, 2024 and pay the Landlords $35,000 plus daily compensation of $86.27 per day starting September 17, 2024 until they vacate.
To provide Tenants time to find new living arrangements
Landlords applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenants remained in possession of the rental unit at the time of the hearing.
Landlords submitted that the Tenants should not be permitted to proceed with their section 82 issues due to non-compliance with the Interim Order.
Tenants sought to raise issues under section 82 of the Act regarding mice, electrical issues and windows that do not open.
Tenants have not made one full rent payment since the Interim Order was issued on February 26, 2024. DF has not been working since May as he is ill and will not be returning to work. Tenants have part-time custody of four children and two children who stay with them every other weekend.
