The Landlord is required to pay the Tenant $8,211.15, which includes $867.36 for rent abatement, $2,820 for increased rent, $1,523.79 for reasonable out-of-pocket expenses, and $3,000 in general damages. The Landlord must also pay an administrative fine of $10,000 to the LTB. The tenancy is terminated as of July 12, 2023.
Tenant applied for an order determining that the Landlord altered the locking system on a door giving entry to the rental unit or residential complex without giving the Tenant replacement keys, substantially interfered with the reasonable enjoyment of the rental unit or residential complex by the Tenant or by a member of their household, and harassed, obstructed, coerced, threatened or interfered with the Tenant.
Landlord claimed the Residential Tenancies Act does not apply because the Landlord lives in the property.
Landlord changed the locks on July 12, 2023 and illegally locked the Tenant out despite being aware of the Tenant's pending A1 application.
Landlord ignored requirements of the Act and tried to circumvent it by pretending to live in the residential complex. Landlord was aware of the Applicants' pending A1 applications but proceeded with evictions anyway.
Tenant collected his belongings approximately 10 days after the locks were changed. Tenant's life at the rental unit was chaotic between May 8th and July 12th, 2023 due to police involvement and the Landlord's attempts to push the Applicants out.
