The Tenant proved some of the allegations in the application. The Landlord must pay the Tenant $784, which includes $78 for excess rent collected, $658 for illegal care service/meal charges collected, and $48 for the cost of filing the application. The Landlord failed to provide proper notice for the March 2024 rent and care service/meal charge increases.
Tenant applied for an order determining that the Landlord collected or retained money illegally. The Tenant challenged the validity of the N3 Notices of Rent Increase and the lawfulness of the rent and care service/meal charge increases.
Landlord's practice is to have residents sign and date when they receive documents, but they often have difficulty getting this Tenant to sign.
Tenant has macular degeneration, making it difficult for her to see and properly read things. She asked the staff member who delivered the 2024 NORI to sign the date of delivery.
