The landlords failed to fully address the leak in the foundation wall, which amounted to a failure to meet their maintenance obligations. The tenant is awarded a rent abatement of $250 and the cost of filing the application, for a total of $298.
Tenant filed applications claiming the landlords substantially interfered with the reasonable enjoyment of the rental unit and failed to meet their maintenance obligations. The main issue was a leak in the basement that occurred in February 2022.
Landlords promptly responded to the February 2022 leak by cleaning up the water and addressing the regrading issue, but failed to investigate or address the condition of the foundation wall itself.
Tenant testified that leaks occurred between 6 and 10 times per year, and that her main reason for bringing the applications was that she was tired of cleaning up the water.
