The Landlords breached their obligations under the Residential Tenancies Act by illegally locking the Tenant out, harassing and threatening the Tenant, and substantially interfering with the Tenant's reasonable enjoyment of the rental unit. The Landlords are ordered to pay the Tenant $14,739.80 and an administrative fine of $7,000.00.
The Tenant applied for an order determining that the Landlords harassed, obstructed, coerced, threatened or interfered with the Tenant, altered the locking system on a door giving entry to the rental unit without giving the Tenant replacement keys, and substantially interfered with the reasonable enjoyment of the rental unit.
Landlords argued an administrative fine would be inappropriate as it is only speculation whether they would repeat this behavior in the future.
Landlords repeatedly demanded the Tenant vacate the rental unit without proper notice, threatened the Tenant, and illegally changed the locks on multiple occasions.
Tenant was frightened and his girlfriend was crying and shaking during the January 4, 2023 incident when the Landlords' hired private security tried to forcibly remove him from the rental unit.
