The Landlord's application is dismissed because the Landlord did not pay the required one month's rent compensation to the Tenant prior to the termination date in the N12 notice, as required by the Residential Tenancies Act.
Landlord applied to terminate the tenancy and evict the Tenant because the Landlord in good faith requires possession of the rental unit for the purpose of residential occupation for at least one year.
Landlord testified that he sent the compensation cheque to the Tenant via US post while he was vacationing in Florida, but could not provide evidence that the cheque was actually mailed.
Tenant testified that he never received the compensation cheque from the Landlord.
