The Landlord's actions amounted to harassment, threats, and substantial interference with the Tenant's reasonable enjoyment. The Tenant is awarded $575 for rent abatement and $900 for increased rent, for a total of $1,475 to be paid by the Landlord.
Tenant filed three applications alleging the Landlord harassed him, substantially interfered with his reasonable enjoyment of the rental unit, and illegally entered the premises. The Tenant sought various remedies including rent abatement, fines, and compensation for increased rent and storage expenses.
Landlord testified he approached Tenant about a rent increase, but did not increase the rent when Tenant refused. Landlord also testified he served N13 notices to some tenants due to bylaw issues, but denied harassing or threatening the Tenant.
Tenant testified Landlord harassed him with constant threats of eviction, repeated notices of entry, screaming at him, and referring to people with disabilities as animals.
