The Tenant proved the allegations against the Landlord on a balance of probabilities. The Landlord must pay the Tenant $18,783.60, which includes rent abatement, damages for destroyed/damaged property, moving/storage expenses, out-of-pocket expenses, and general damages. The Landlord must also pay a $7,000 administrative fine to the LTB.
Tenant applied for an order determining that the Landlords (Don Horwood and Glen Horwood) entered the rental unit illegally, altered the locking system without providing replacement keys, substantially interfered with the Tenant's reasonable enjoyment, and harassed, obstructed, coerced, threatened or interfered with the Tenant.
