The Landlord has proven the grounds for termination of the tenancy and the claim for compensation. The tenancy is terminated on August 24, 2024. The Tenant must move out by that date or the Landlord can file the order with the Sheriff for enforcement. The Tenant owes the Landlord $11,632.44 in daily compensation for use and occupation of the unit from August 1, 2024 until the Tenant moves out. The Landlord owes the Tenant $1,690.26 for the rent deposit and interest.
Landlord applied for an order to terminate the tenancy and evict Tenant because the Landlord in good faith requires possession of the rental unit for the purpose of residential occupation for at least one year by the Landlord's son.
Landlord testified that his son and his son's children are living in his 1400 sq ft home and it is a little too close for comfort. Landlord tried to help support his son by applying for a mortgage but was declined.
Tenant asserts the Landlord is giving the notice of termination in bad faith as the Landlord really wants more rental income for the rental unit.
Tenant operates businesses out of the rental unit and submitted it would be difficult to change the address on everything advertising the business.
