The Landlord is ordered to pay the Tenants a rent abatement of $83.22 and $45 for the cost of filing the application, for a total of $128.22. If the Landlord does not pay by April 19, 2021, the Tenants may deduct $83.22 from the May 2021 rent and the Landlord will owe interest on the outstanding balance.
Tenants applied for an order determining that the Landlord failed to meet its maintenance obligations under the Residential Tenancies Act, 2006 or failed to comply with health, safety, housing or maintenance standards. The issues were related to damage to the main entrance intercom and remote security, and issues with the underground parking garage.
The Landlord's Agent testified that the temporary vestibule was secure and could be locked, and that the repairs were delayed due to the COVID-19 pandemic.
Tenant Wesley Squires testified that the Landlord did not replace the remote buzzer for the front door, allowing people to gain access to the building.
